Champion Chase is a trading name of TIDEYDAVIES Limited. The following Terms & Conditions (“Terms”) apply to all of TIDEYDAVIES Limited  trading as Champion Chase (“CHAMPION CHASE”, “Champion Chase”, “Champion Chases’s”, “CHAMPION CHASES’S”, “championchase”, “CHAMPIONCHASE”, “us”, “we”, “our”) websites and affiliate programmes or services including orders placed by telephone. By placing an order via the website (“championchase.com”) (our “Website”) or by telephone, the customer (“you”, “your”, “Customer”) confirm your unconditional acceptance of these Terms. Please read this document carefully before placing an order with us.

We may change these Terms from time to time. The latest version of these Terms is available on our Website. Whilst they remain posted on our Website, these Terms will apply to all transactions carried out via our Website and by telephone.

1. Scope

1.1 In these Terms:
1.1.1 “Customer” means a person acting as a consumer who is purchasing goods outside the course of his or her business or trade;
1.1.2 “you” means the Customer submitting an order for Goods;
1.1.3 “Goods” means the Goods to be supplied under these Terms;
1.1.4 “Party” means either you or us; “Parties” means you and us;
1.1.5 “Writing” means letter or email.
1.1.6 “Product” means Goods to be supplied under these Terms;
1.2 The contract for supply of Goods (“Contract”) will be formed when we accept your order. Acceptance of an order by us can only be made in Writing save where ordering Goods over the telephone. Once the Contract has been formed with you we will file it electronically for our records. All orders are subject to availability.
1.3 Orders may only be placed by Customers aged 18 and over.
1.4 In deciding whether to accept your order we may carry out a credit check and then will only accept your order if we are satisfied with the results of such a check. You confirm that you agree to us carrying out such a check.
1.5 These Terms may only be changed in a document signed by one of our directors.
1.6 Any omission or error in any sales literature, or in any advertisement whether in newspapers, magazines, on the Internet or otherwise or in any invoice or other document issued by us may be corrected by us without liability.
1.7 By accepting the Contract you confirm that you are a Customer in the countries listed in clause 4.8.
1.8 We can only accept orders from Customers who reside in the countries listed in clause 4.8
1.9 The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded from the Contract so that no third party may claim any rights under this Contract.
1.10 These Terms comply in all respects with The Consumer Contracts Regulations
1.11 Clause headings are for convenience only and do not affect the interpretation of these Terms. Words in the singular include the plural and vice versa.

2.3 All content of this Website is either the property of TIDEYDAVIES Limited, or is used under license by us and is protected by international and UK copyright and intellectual property laws. Notably, all pictures, images, logos, videos, texts, product designs, patents and suchlike depicted on this Website are owned by or licensed to us.

2.4 You are not allowed to copy, reproduce or modify the contents of this Website or any of Champion Chase trademarks and patents without prior written consent.

2.5 Our Website may be linked to or from other websites operated by third parties not affiliated to us. Although We do our best to make sure that all third party websites linked to us are as relevant and trustworthy as possible, we cannot control third party websites and therefore cannot be held responsible for their contents.

3. Privacy Policy, Cookies & Security

3.1 Champion Chase is committed to producing the highest level of service and privacy to its customers. We have implemented secure transaction procedures for all your on-line activity via this website using encrypted SSL technology. Any credit or debit card details submitted by you on our Website will not be stored on our systems but by our payment processors. A padlock symbol should appear in your browser window when you are in a secure environment.

3.2 We may collect some personal information that you submit voluntarily when purchasing Goods from us. This information will be stocked and used with utmost care by us to provide your requested services, such as delivery of Goods purchased on our Website and confirmation of your order via the e-mail address provided.

3.4 When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Send you information about your account and order
  • Respond to your requests, including refunds and complaints
  • Process payments and prevent fraud
  • Set up your account for our store
  • Comply with any legal obligations we have, such as calculating taxes
  • Improve our store offerings
  • Send you marketing messages, if you choose to receive them

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

3.5 We may share your information with affiliated companies and/or business partners who provide services on our behalf, for example with our carriers who will deliver your orders and our payment processors where you submit you credit/ debit card details. In these cases, we will only provide them the information that they need to perform their functions and we require of them the highest level of service possible.

We accept payments through PayPal and Stripe. When processing payments, some of your data will be passed to PayPal and Stripe, including information required to process or support the payment, such as the purchase total and billing information.

We also use various couriers and sometimes third party fulfillment centers to process and deliver orders placed on this website. Your data will be passed to these third parties to enable them to deliver your order.

We mainly use Royal Mail and Fedex to deliver customer orders if shipped from our main warehouse in the UK.  However as we sell our products globally we do hold stock in many countries and therefore your order maybe despatched from one of the fulfillment centers we use around the globe depending on where you are based. If your parcel is shipped from one of the fulfillment companies then we cannot know which courier they will use. We currently use Amazon for fulfillment of some of our international orders.

3.6 National and International Data Transfers.

Personal Data may be stored and processed in any country where we have operations or where we engage service providers. We may transfer Personal Data that we maintain about you to recipients in countries other than the country in which the Personal Data was originally collected, including to the United States. Those countries may have data protection rules that are different from those of your country. However, we will take measures and do our best to ensure that any such transfers comply with applicable data protection laws and that your Personal Data remains protected to the standards described in this Privacy Policy. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Data.

4. Terms of Use & Purchase

4.1 General Provisions & Content

4.1.1 These Terms create an agreement between you and us and determine the terms and conditions of use for this Website and for the purchase of goods on this Website.

4.1.2 The purpose of this Website is to present our company, its background, its products and services. We also provide an on-line shop, where customers can buy a range of Champion Chase products to be delivered nationally and internationally. Although we have endeavoured to make sure that all content is correct and up-to date, some minor errors may appear, for which we cannot be held responsible. Moreover, because this Website is accessible from many parts of the World, it is in your interest to ensure that viewing the content of this Website or using our services does not infringe local laws.

4.2 Descriptions & Product Information

4.2.1 Although we endeavour to give as accurate and complete descriptions as possible of the Goods sold on this Website, we cannot be held responsible for the minor errors that may occur.

4.2.2 Moreover, we have taken as many product pictures as possible, from different angles, to show you as many product features as possible and to help you choose the right Goods to purchase. However, due to different screen resolutions and the complexity of some colours and photography angles, we cannot guarantee that what you see on screen will accurately reflect the actual Goods.
In the unlikely event that you should not be satisfied with the Goods that you receive, please refer to our Returns Policy below in clause 4.6.

4.2.3 Our products are made from aniline vegetable tanned leather. This is one of the most natural types of leather and is considered to be a very high quality product within the leather industry. Soluble dyes are used in aniline leather that penetrate the hide giving the leather its rich colour. In order to maintain the natural feel and look of the hide no protective coating or surface pigmentation is applied. Additionally, the leathers maintain their natural markings and texture which contributes to the authenticity of the leather. However, the lack of treatment might render the leathers more susceptible to scratching, staining, or fading and might show some colour variations on the surface of the hide. Also due to the type of dyes used in Aniline leather the colour can sometimes transfer from the leather to other items particularly lighter garments. Therefore please note that we cannot guarantee this will not occur when wearing or using our products. Champion Chase accepts no liability with regards to colour transfer from any of our articles.

4.3 Purchasing, Pricing & Tax

4.3.1 All prices shown on our Website are in UK Sterling (£, GBP). The price includes UK VAT  but will adjust once the shipping address is updated. If you are based outside the UK then no TAX is charged as the checkout.

4.3.2 If you live outside the UK and have Goods sent outside the UK, then you maybe liable for further customs duty (import tax) that may be applied after we have despatched your goods and we cannot be held responsible for any further costs due to local customs and duty taxes. The carrier will generally ask the recipient to pay for this import tax upon delivery.

4.3.3 To purchase a product, simply click on the appropriate button to add it to your shopping bag, then continue browsing and/or access your basket to check out. Then simply follow the guidelines on each new page to review your selected Goods, set the billing and delivery details and finally pay for the Goods via the secure e-commerce gateway or Paypal.

4.3.4 All information on our Website is an invitation to treat only and is not an offer or unilateral contract. Your order represents an offer by you to purchase the Goods. We will acknowledge receipt of your order without delay by sending a confirmation email. Please note however that such confirmation email does not constitute acceptance of your order. We do hold most items in stock but we sometimes make to order and therefore there may be a small waiting time of a few days before we can despatch your goods.

4.3.5 The sale will only be binding on us once we have notified you that the order is accepted and the Goods have been despatched by us. This means that if Goods are shown on our Website but are not available or are incorrectly priced or otherwise incorrectly described, we shall not be obliged to sell you such Goods. Your card will be charged when you submit your order but should we be unable to fulfill the order it will be refunded at the earliest opportunity.

4.3.6 We currently accept most major credit/debit cards in our secure payment gateway including American Express.

4.5 Delivery

4.5.1 All Goods are presented in protective wrapping. We then safely pack all your purchased Goods in a despatch box (or padded Jiffy bag for small accessories such as leather keepers/loops), ready for delivery.

4.5.2 We deliver goods globally. Transit time for each delivery will vary depending on the destination. In any event, delivery times are given as estimates and we cannot be held responsible for minor delays. Estimated delivery times can be seen in clause 4.8. Goods are usually despatched within two working days of receipt of the order if despatched from our UK warehouse so if your order is received on Thursday or Friday it may not be despatched until early the following week. However if you have selected an Express Delivery Service we always aim to despatch the same or following working day. We do not despatch over the weekend and orders received during this time will be despatched during the following week.

4.5.3 The cost of delivery will appear on your shopping list only when you have added the desired Goods to your shopping basket and entered the country the Goods are to be delivered to. The delivery price depends on the country the Goods are to be delivered to. There are six regions which are listed below under clause 4.7 and 4.8 along with a breakdown of the cost of delivery for each region. Delivery cost is based on the delivery address.

4.5.4 If, at the time of delivery, the packaging is damaged, please open the package in the presence of the carrier in order to verify the condition of the Goods. In the event of damage to the Goods, you should note down the details and then notify us via email as soon as possible then follow our Returns Policy (see clause 4.6).

4.5.5 We shall replace, free of charge any Goods damaged or lost in transit where delivery has been made by our carrier, provided that:

4.5.6 you give us written notification of such damage or loss, in the case of loss: within a reasonable time period of the anticipated delivery date after you placed your order, in order that we may comply with our carrier’s conditions of carriage;

4.5.7 you produce to us (in the case of a claim for damage) the original packaging for the Goods and the Goods themselves.

4.6 Returns Policy

4.6.1 We abide by the The Consumer Contracts Regulations:

4.6.2 Because you can’t see the Goods purchased before they are delivered to you, the CCR state that you can cancel any on-line order, for whatever reason, unless this order has been personalised or made specially for you.

4.6.3 You are legally entitled to cancel your order within 14 (fourteen) working days after the day of delivery, although we are happy to extend this time and allow you to cancel your order within 30 (thirty) working days after the day of delivery.

4.6.5 Before sending the Goods back to us, you must complete a Returns Form which will be inside the packaging of the purchased Goods when initially delivered, complete and send back the form with the cancelled purchase. If you do not have the Returns Form then please request one via this email address: contact@championchase.com and we will email the form to you.

4.6.6 Please note that you have a statutory duty to take reasonable care of the Goods you wish to return. You are responsible for any damage occurring after you have received the goods, including during the return transport.

4.6.7 Please make sure you return the Goods unused and undamaged, with the original gift box (if applicable) and copy of the invoice/packing slip using a protective outer packaging. Should you return faulty Goods or Goods damaged in transit, please mention damage or faults accordingly in the Returns Form and state if you would like a refund or a replacement. We also recommend that you obtain proof of postage and check that the goods are insured for their full value in case they are lost in transit (Royal Mail usually include cover up to a certain value). We cannot refund you if we do not receive the Goods.

4.6.8 A refund can only be raised for the returned Goods once the undamaged and unused Goods have been received. If the Goods were returned due to a fault or because they were damaged in transit then we will also reimburse you for the cost of the return carriage once the faulty or damaged Goods have been received and inspected.

4.6.9 Once you have cancelled your order, you are entitled to a full refund of the Goods, although this does not include the return postage fees. If you are returning items delivered within the UK then we will refund the standard price delivery fee if returned within 14 days of receipt (although we do not refund express delivery fees). The return postage and packaging costs incurred by you are not refundable. All return costs shall be borne by you – the customer. However if we include a free returns label then you will not be charged for the return postage. We will endeavour to reimburse your payment within 5 (five) working days of receipt of the Goods and we will email you a notification. If we offered a free delivery service for orders over a specific value and you subsequently choose to  return part of your ordered items that result in the total value of the purchase being below the threshold for a free delivery service then the standard delivery fee will be deducted from the refund.

NOTE: Simply refusing delivery of a parcel isn’t an acceptable means of return AND MAY NOT BE TRACKABLE and is not covered under this Returns Policy. You may not receive a refund if a parcel is refused as it may not be trackable and there is a chance we may not receive it. Should we receive a returned parcel that has been refused then you will be charged for the returned postage costs that is charged to us by the courier service used.

On occasion there will be times we cannot deliver to some countries usually due to poor weather conditions or because they are in war torn areas. We will notify you if we receive an order that cannot be fulfilled and a refund will be processed.

4.9 Governing Law

These Terms and all transactions relating to this Website are governed by English Law. Any disputes in relation with this Website will be resolved in the Courts of England or Wales.

You are required to check, before using this Website or our services, that you comply fully with your local laws and regulations. You must not use this Website if doing so would breach such local laws and regulations.
